In the event, Denmark pulled back from the brink. Following my piece here a few days ago about the witch-hunt against the President of the Danish Free Press society Lars Hedegaard, the Danish Supreme Court ruled last Friday that he was not guilty after all of hate speech and racism – the second time he has been acquitted of this charge in a roller-coaster of a case which has stained Denmark’s reputation for justice, free speech and common-sense.

So a victory, certainly — but still only two cheers for Denmark’s legal system.  First, as has been the case throughout this saga, the acquittal – like the previous acquittal and conviction – turned merely on the narrow question of whether the remarks by Hedegaard which were in contention had been made in a private forum. The Supreme Court decided that he had had ‘no intention of disseminating his remarks to a wider audience’, and that therefore no offence had been committed.

Lars Hedegaard is President of the Danish Free Press Society, which is devoted to defending freedom of expression — particularly against the threat from radical Islam to extinguish it on the spurious grounds of ‘Islamophobia’.  With no sense of irony, Denmark is trying its damnedest to shut Hedegaard up on precisely those grounds.

The Prosecutor Lies in Wait

Article 266b, under which I was charged, remains unchanged. Thus, we still have no right to refer to truth if we are indicted under this article.

I am satisfied that the Supreme Court has delivered a verdict in accordance with the evidence given in lower and superior court. The prosecution had this evidence before it decided to press charges so I cannot understand why it went ahead.

The prosecutor has burdened the courts and the taxpayers needlessly for more than two years.

This judgment is not necessarily a victory for free speech. Article 266b, under which I was charged, remains unchanged. It remains a disgrace to any civilised society and is an open invitation to frivolous trials. Thus, we still have no right to refer to truth if we are indicted under this article.

Free Speech Found Guilty by Europe

The ruling showed that while Judaism and Christianity can be disparaged with impunity, speaking the truth about Islam is subject to swift and hefty legal penalties. The Supreme Court stressed that the substance of the charges — public criticism of Islam – is still a crime punishable by imprisonment. Under Danish law, it is immaterial whether a statement is true or false. All that is needed for a conviction is for someone to feel offended.

Lars Hedegaard, the president of the Danish Free Press Society, has been acquitted by the Danish Supreme Court on charges of “hate speech” for critical comments he made about Islam.

The verdict, however represents only a partial victory for free speech in a Europe that is being stifled by politically correct restrictions on free speech, particularly on issues related to Islam.

Intrepid Danish journalist, historian and President of the Free Press Society Lars Hedegaard, has been acquitted unanimously by a panel of seven Supreme Court justices.  led by Chief Justice Børge Dahl. Hedegaard was accused of intentionally denigrating Muslims in breach of Article 266b of the Danish Penal Code, which states,

Whoever publicly or with the intent of public dissemination issues a pronouncement or other communication by which a group of persons are threatened, insulted or denigrated due to their race, skin color, national or ethnic origin, religion or sexual orientation is liable to a fine or incarceration for up to two years.

Danish Supreme Court Acquits Hedegaard

On April 20, 2012 in a 7-0 decision, the Danish Supreme Court acquitted Lars Hedegaard of violating Article 266(b), the infamous “hate speech” provision of the Danish penal code.

Hedegaard’s case has been winding its way through the courts for some time now.  Readers will recall that he was first acquitted and then retried and convicted—a decision he appealed to the country’s highest court.

There is sweet justice in Denmark. We received news that the Danish Supreme Court acquitted Lars Hedegaard, President of the Danish Free Press Society of Prosecutor charges of ‘racism’ and “hate speech under Article 266b of the penal code that were upheld in a conviction and fine by the Eastern Superior Court in May 2011.  The headline of the Supreme Court  press release was “Dismiss the case on insulting and degrading statements about Muslims “  This is a major victory for free speech in Denmark and the EU.  This legal victory in Denmark should also be welcome news to the Hon. Geert Wilders in The Netherlands and hopefully useful news for Elisabeth Sabaditsch-Wolff in her legal proceedings in Austria. The opinion of the seven justices convened by the Danish Supreme Court was posted on the website of the Danish Supreme Court. Hedegaard indicated that he will have an English translation for us later today along with observations about the decision. As we can appreciate it he has been swamped with congratulatory phone calls and interviews by the Danish press. In our last post on  Hedegaard’s Supreme Court case heard last Friday, we noted:

We had the occasion today to speak with Lars Hedegaard, President of the Danish Free Press Society (DFPS) about the circumstances behind yesterday’s hearing before the Danish Supreme Court.  A mutual Canadian colleague and friend, Bjorn Larsen,  flew to Copenhagen to observe the proceedings. Larsen is a Board Member of both the Canadian and International Free Press Society. He sent us some photos of Hedegaard and his counsel, Karoly Németh and DFPS board member, Jette Dali.  Németh escaped from his native Hungary as a teenager during the 1956 Revolt and has become a brilliant advocate in his adopted country. Németh arrived at the Supreme Court on his own power. He rode a bicycle. Larsen said in an email that the entire proceeding lasted approximately three hours. The prosecutor spoke for almost two hours, Nemeth for 40 minutes and Hedegaard for approximately 10 minutes. [...]

Bruce Bawer PhotoIn 2009, the Danish writer and historian Lars Hedegaard, who is the founder and president of the Danish Free Press Society, made remarks in his home about the treatment of women in Muslim communities.  His observations, while expressed in broad generalizations, were based in fact, although when they were made public and resulted in widespread criticism he apologized for the way he had expressed himself.  This was not good enough for the Danish courts.  He was charged with violating Denmark’s racism law, and went to trial in January 2011.  He was acquitted, but was tried again on the same charges three months later.  This time he was found guilty.  Last Friday Hedegaard initiated an appeal of his conviction before the Danish Supreme Court.

Not so many years ago, such a story would have been regarded as nothing less than sensational: a writer is put on trial in a Western country for making critical remarks about a certain religion’s ideology and practices.  The unsettling truth is that the more often the sensational happens, the less and less sensational it becomes.  In recent years, the Western world has grown used to seeing writers hauled before official tribunals – Mark Steyn in Canada, Oriana Fallaci in Italy, Elisabeth Sabaditsch-Wolff in Austria – invariably for criticizing Islam.  It doesn’t help that the mainstream media, with very few exceptions, almost always report on these actions as if they were anything but sensational: they’re treated as ordinary, reasonable, and legitimate judicial proceedings.

A Pivotal Week for Norway’s Resident Jihadist

When we last left Mullah Krekar, Norway’s top-seeded resident jihadist, author, and Dancing with the Stars contestant (OK, I made that last one up, but not too long ago it would’ve been entirely conceivable), he was reportedly packing up his old kit bag and preparing to move back to his native Iraq.  His intention, he announced, was to give courses in how to strap explosives to your kid – sorry, I mean, in Islamic theology.

Well, as it turns out, rather amazingly, the Norwegian judiciary has upset Krekar’s plans.

Here’s the story.  Back in June 2010, Krekar – who at the time was facing possible expulsion to Iraq, where he insisted he was in danger of execution –issued the following warning: “My death will cost Norwegian society.  If, for example, Erna Solberg tossing me out of the country leads to my death, she will suffer the same fate.”  Solberg is head of the Norwegian Conservative Party.

Earlier this month, under the headline “Words are not innocent,” the Swedish newspaper Dagbladet ran an opinion piece by its cultural editor, Kaj Schueler, which was, essentially, an attack on Sweden’s newly minted Free Press Society.  It was one of several such attacks directed at the organization in recent weeks by members of Sweden’s mainstream media, all of which made essentially the same arguments as Schueler – who, early in his article, summed up his position as follows: “According to the Free Press Society, we no longer have real freedom of speech in Sweden.  They are wrong – we have it.  But since words are not innocent, there are limits to free speech.”

U.K. Thought Police Send Man to Prison

A few days ago I did some reflecting here on the steady rise of sharia in Britain, as exemplified by the BBC’s frank admission of its unwillingness to mock Islam, the harassment of an air passenger for an innocuous remark about hijab, and the see-no-evil response of a BBC reporter to mass displays of pro-sharia aggression in Luton.

Alas, the evidence of Britain’s decline and fall in the face of Islam just keeps on coming.  This week’s case in point is that of Darren Conway, who on March 6 was sentenced to a year in prison for posting anti-Islamic materials in the window of his ground-floor apartment in Gainsborough, Lincolnshire.  As the BBC puts it, he was “convicted of a religiously aggravated public order offence for putting anti-Islamic literature in his window.”

After last week’s killing of three children and a rabbi at a Jewish school in Toulouse, early reports suggested that the murderer was a white, right-wing racist who was targeting minorities.  Indeed, one could be excused for getting the impression, from those first accounts, that the authorities and the media wanted him to be a white, right-wing racist – a lone maniac like the guy who mowed down dozens of teenagers in Norway last July.  Yet the Toulouse terrorist turned out, like so many perpetrators of unspeakable European atrocities in recent years, to be an Islamic jihadist – a self-declared Mujahideen and member of al-Qaeda who said he was out to avenge the deaths of Palestinian children and the military involvement of France in the Islamic world, and who, if a van had not blocked the path of his scooter, might have succeeded in executing as many young people as Anders Behring Breivik did on the island of Utøya.

Remembering Mike Wallace

Channel surfing the other night, I ran across All the President’s Men for what felt like the thousandth time.  I came in about twenty minutes before the end, and – not for the first time – I felt compelled to watch it to the end.  What a splendidly written, brilliantly directed, terrifically acted movie!  What a stirring story!  What a beautiful piece of filmmaking, from the cinematography to the lighting design!  And what a crock!

All the President’s Men converted a generation of innocent, impressionable, pre-Internet Americans – myself included – into unthinking fans of the mainstream news media.  Some people in the government might be out to screw us over, and certainly every last man and woman in corporate America was up to no good, but the knights in shining armor at the Washington Post, the New York Times, and the network news divisions were there to come to our rescue – to save our freedoms and preserve our Constitution, wielding the truth like a shining sword.

Min forsvarer har fremdraget de juridiske argumenter, der taler for, at jeg skal frifindes, og dem skal jeg ikke yderligere kommentere.

Once again, freedom of speech is under attack in Europe. Lars Hedegaard’s appeal to the Danish Supreme Court will be heard April 13th along with the prosecutor’s cross-appeal seeking a higher fine. Court proceedings are anticipated to wrap up the same day and a decision is expected within a week.

On Friday the 13th, Lars Hedegaard will have his appeal to the Supreme Court heard seeking to overturn his conviction and fines under an arcane Danish law.   Hedegaard is President of the Danish Free Press Society  and one of three heroes of conscience in an EU Country tried for exercising free speech,the criticism of Islam.  Together with the Hon. Geert Wilders in The Netherlands and Elisabeth Sabaditsch-Wolff in Austria, Hedegaard’s predicament and theirs have been captured in interviews in the recently published collection, The West Speaks.  Of the trio of free thinkers, only Wilders has been acquitted of all charges.  We noted this as an update at the conclusion of Hedegaard’s interview:

As a small country, Denmark is not very influential within the European Union. But ever since then there appeared the Mohammed cartoons, the country became the focus of international attention. Citizen Times Editor in Chief Felix Strüning spoke with the Dane Lars Hedegaard, president of the International Free Press Society, on developments in his country, the chances of a peaceful solution to the problem of Islam and what he would do with one million Euros.

Citizen Times: Mr. Hedegaard, six years ago, the Danish newspaper Jyllands-Posten published the famous twelve Mohammed cartoons. Kurt Westergaard, one of the artists, still needs police protection. So, how is the mood in the Danish population right now?

Lars Hedegaard: There are some indications that parts of the public are getting tired and would dearly like to return to a state of “normality”. In early March the leading PC-paper Politiken even claimed that the debate over Islam and immigration is over – which is exactly what the paper would like to happen.

In Denmark, sticks and stones may break your bones, but insulting words will get you fined — to the tune of 5,000 kroner (or about $1,000). Article 266(b) of the Danish penal code, one of the more sweeping of the “hate speech” provisions, criminalizes, among other things, merely insulting groups of people due to their membership in enumerated protected classes.

On April 13, 2012, Lars Hedegaard — a journalist, historian, and president of the Danish Free Press Society – takes the appeal of his conviction under Article 266(b) to the Danish Supreme Court. Readers may recall that back in January of 2011, Hedegaard was tried and acquitted for remarks he made during a 2009 interview concerning sexual abuse within Muslim communities. (In a related story, Danish MP Jesper Langballe “confessed,” pleading guilty to violating Article 266(b) for remarks he made in support of Hedegaard.) But, in a strange twist, Hedegaard’s acquittal was appealed. He was retried on April 26, 2011, and convicted on May 3.

The Swedish press is known for notoriously hiding facts and consequences concerning Islam, immigration and Muslim criminals (example: Swedish specialty: Pink pixellation of dark-skinned criminals and pixellated anonymization of wanted criminals).

Perhaps you have heard of taqiyya, the Muslim doctrine that allows lying in certain circumstances — primarily when Muslim minorities live under infidel authority. Now meet tawriya, a doctrine that allows lying in virtually all circumstances—including to fellow Muslims and by swearing to Allah—provided the liar is creative enough to articulate his deceit in a way that is “technically” true.

Deceit and lying may be far more ingrained in the culture than previously thought.

The authoritative Hans Wehr Arabic-English Dictionary defines tawriya as, “hiding, concealment; dissemblance, dissimulation, hypocrisy; equivocation, ambiguity, double-entendre, allusion.” Conjugates of the trilateral root of the word, w-r-y, appear in the Quran in the context of hiding or concealing something (e.g., 5:31, 7:26).

As a doctrine, “double-entendre” best describes tawriya’s function. According to past and present Muslim scholars, several documented below, tawriya occurs when a speaker says something that means one thing to the listener, although the speaker means something else, and his words technically support this alternate meaning.

Refuting Muslim Apologetics Concerning Tawriya (“Creative Lying”)

Sam Shamoun of Answering Islam recently forwarded me an article titled “Tawriya: Islamic Doctrine of ‘Creative Lying’? Response to Raymond Ibrahim,” appearing on a website called Muslim Debate Initiative, and written by one Shadid (“Severe”) Lewis in response to my recent exposition on the doctrine of tawriya. Although this response—poorly written, poorly argued—would normally be ignored, I address it for three reasons: 1) To date, it is the only rebuttal I have seen from a Muslim concerning tawriya; 2) Far from rejecting tawriya, it actually validates it (the author spends his time chasing red herrings, not disproving the doctrine); 3) It is a good example of the speciousness and sophistry employed by those who try to downplay or rationalize some of Islam’s more problematic doctrines, in this case, tawriya. (Note: Although Shadid’s original article is littered with grammatical and punctuation errors, in the interest of readability, I have corrected the more egregious when quoting him.)

At the start, after informing readers that he “read the article of Raymond Ibrahim posted on Frontpagemag.com and I just had to respond,” Shadid argues that tawriya really “means deliberate ambiguity rather than creative lying.” Discerning readers understand such euphemisms change nothing about the doctrine.

Logo Family Security MattersOne shouldn’t wonder much about why Norway, Sweden, and Demark are willing to submit, like “Britainistan,” without so much as an audible whimper, to their steady Islamization, to their becoming de facto departments of a growing international caliphate. All three countries are welfare states that welcomed Muslim immigrants by the planeload over the decades to perform the work which entitlement-obsessed and welfare benefits-seduced Scandinavians no longer wished to perform. “Islamophobes” they were not. And still aren’t, even though their skyrocketing crime rates are directly attributable to immigrant and second-generation Muslims.

All three countries are governed by leftist elites, by political parties that redistribute other people’s money and spread the wealth around a lot. The Left has made an alliance with Islam, which wants to spread its creed around across the board and impose its ideology on non-Muslims by guile or force. There are, however, two camps of the Left. There is the Left that hates the West as much as do the Muslims, and will do anything to destroy it, even if it means its own dhimmitude and demise under Sharia law and submission. One could not imagine another group in that part of the globe more dedicated to the destruction of their own country. “We will be multicultural and non-judgmental, even if it means our own deaths. It is the right thing to do. We will be virtuous, even if it means accepting penance for our culture being superior to Islamic culture.”

It is a statement of the obvious to say that since the Ancient Greeks writers have known that the powerful are more dramatic than the rest of us. You do not need me to tell you that their decisions can improve or destroy individuals or nations; that what leaders do with power shows their character in the clearest light, and teaches the rest of us hard truths about human nature. Someone needs to tell the controllers of television, however. Their disdain for politics in part explains the collapse of British TV drama from world leader to also-ran.

Media managers still commission excellent one-off drama-documentaries — Peter Morgan’s films about the Blair years, for instance. But drama series come from the classics, or the tired detective genre or feel-good scripts written by and for Middle England because editors lack the imaginative intelligence to see their society in the round.
